Welcome to Learn 360, a cloud-based Learning Management System (“Learn 360”, “Platform”, “Service”) operated by Edutain360, LLC, a Delaware limited liability company with its principal office at 2950 Motlow Creek Rd, Campobello, SC 29322, United States (“Edutain360”, “Company”, “we”, “our”, or “us”).

This Privacy Policy explains how we collect, use, disclose, store, and protect personal information when you access or use Learn 360, visit learn-360.com, create an account, purchase a subscription, or otherwise interact with our Services.

By using Learn 360, you agree to this Privacy Policy. If you do not agree, please discontinue use of our Services.

1. Scope

This Privacy Policy applies to:

  • Learn 360 platform

  • Organization Owners
  • Administrators
  • Learners
  • Customer support
  • Billing and subscriptions

This Privacy Policy does not apply to third-party websites, payment providers, or services that have their own privacy policies.

2. Definitions

Organization means any company, business, educational institution, consultant, nonprofit, or other entity using Learn 360.

Organization Ownermeans the individual responsible for an Organization's subscription and account.

Administratormeans an individual authorized to manage an Organization's workspace.

Learner means an individual enrolled in courses provided through Learn 360.

Personal Information means information that identifies or can reasonably identify an individual.

3. Controller and Processor

Learn 360 acts in different roles depending on the information involved.

We are the Data Controller for:

  • Website visitors
  • Customer accounts
  • Billing
  • Subscription management
  • Customer support
  • Business communications

We are the Data Processor for:

  • Learner information
  • Course data
  • Learning progress
  • Certificates
  • Organization-created content

Organizations determine how learner information is collected and used. Learn 360 processes that information solely to provide the Services. This processing is further described in Section 15 (Data Processing) below.

4. Information We Collect

Depending on how you use Learn 360, we may collect:

Account Information

  • Name
  • Email address
  • Password (securely hashed)
  • Organization name
  • User role
  • Profile information

Organization Information

  • Organization name
  • Subscription plan
  • Billing information
  • Branding assets
  • Administrative users

Learner Information — Organizations may store:

  • Name
  • Email address
  • Course enrollments
  • Learning progress
  • Assessment results
  • Completion records
  • Certificates
  • Attendance records

Course Content — Organizations may upload:

  • Courses
  • Videos
  • Documents
  • Images
  • Assessments
  • Certificates
  • Learning materials

Ownership of all uploaded content remains with the Organization or its licensors.

Communications — When you contact us, we may collect:

  • Emails
  • Support requests
  • Feedback
  • Feature requests
  • Bug reports

Technical Information — We automatically collect limited technical information including:

  • IP address
  • Browser type
  • Device information
  • Login timestamps
  • Session information
  • Error logs
  • Security logs

Payment Information — Subscription payments are processed securely by a third-party payment processor.

We never store on our own systems:

  • Full credit card numbers
  • CVV codes
  • Banking credentials

We receive only limited billing information required to manage subscriptions.

5. How We Use Information

We use personal information to:

  • Provide and maintain the Services
  • Create and manage accounts
  • Authenticate users
  • Deliver course content
  • Track learning progress
  • Generate reports and certificates
  • Process subscriptions
  • Respond to support requests
  • Improve platform performance
  • Prevent fraud and unauthorized access
  • Comply with legal obligations
  • Enforce our Terms of Service

We do not sell your personal information.

We do not use customer or learner data to train artificial intelligence models.

6. Legal Basis for Processing

Where required by applicable law, we process personal information based on:

  • Performance of a contract
  • Compliance with legal obligations
  • Legitimate business interests
  • Your consent, where required

7. How We Share Information

We do not sell or rent personal information. We share information only as necessary, and only with the following categories of recipients:

  • Payment processors — to process subscription payments and manage billing.
  • Hosting and infrastructure providers — to securely host and operate the Learn 360 platform.
  • Communication, CRM, and analytics providers — to manage onboarding, customer communications, support, and to understand and improve how the Services are used.
  • Professional advisors — such as lawyers, accountants, auditors, or consultants, where necessary.
  • Legal authorities — when required by law or to protect our rights, users, or Services.
  • Business transfers — if Learn 360 is involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction.

We require our service providers to protect personal information and to process it only on our instructions. A current list of our sub-processors is available on request (see Section 15).

8. Cookies and Tracking Technologies

Learn 360 uses cookies and similar technologies. We use different categories of cookies for different purposes:

  • Essential cookies— required to operate the Services, such as login session, “Remember Me”, and security cookies. These cannot be switched off.
  • Analytics cookies — help us understand how visitors use our website and platform so we can improve them.
  • Marketing cookies — set by us or our communication and marketing providers to support onboarding, measure campaigns, and deliver relevant messages.

Where required by applicable law, we request your consent before setting non-essential (analytics and marketing) cookies, and you can accept, decline, or manage these cookies through our cookie banner or preferences tool. You may also configure your browser to block or delete cookies, although doing so may affect certain features of the Services.

9. Data Retention

We retain personal information only as long as necessary to:

  • Provide our Services
  • Comply with legal obligations
  • Resolve disputes
  • Enforce our agreements

When an Organization or account is deleted:

  • Data enters a 30-day recovery period during which it may be restored.
  • After the recovery period, data is permanently deleted from active systems.
  • Encrypted backups may retain deleted information for up to 30 additional days before automatic removal.

Certain financial or legal records may be retained longer where required by law.

10. Data Security

We implement reasonable administrative, technical, and organizational safeguards to protect personal information.

These measures include:

  • HTTPS encryption
  • Secure password hashing
  • Role-based access controls
  • Authentication controls
  • Activity logging
  • Secure hosting
  • Tenant isolation between Organizations
  • Regular security updates

Although we work to protect personal information, no method of electronic storage or transmission can be guaranteed to be completely secure.

Breach notification. If we become aware of a data breach that affects your personal information, we will notify affected users and the relevant authorities as required by applicable law, without undue delay.

11. International Data Transfers

Learn 360 is available worldwide.

Your information may be processed or stored in the United States and in other countries where we or our service providers operate.

Where we transfer personal information out of the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate safeguards recognized under applicable law, such as the European Commission's Standard Contractual Clauses (and the UK Addendum), or another lawful transfer mechanism.

12. Your Privacy Rights

Depending on your location, you may have the right to:

  • Access your personal information
  • Correct inaccurate information
  • Request deletion
  • Request data portability
  • Object to certain processing
  • Restrict processing
  • Withdraw consent where applicable

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you also have the right to lodge a complaint with your local data protection supervisory authority.

If you are a Learner, your Organization may control your information. In such cases, requests should generally be directed to your Organization first.

13. California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (as amended by the CPRA) provides you with specific rights regarding your personal information, including the right to:

  • Know what personal information we collect, use, and disclose;
  • Request access to, or deletion or correction of, your personal information;
  • Opt out of the “sale” or “sharing” of personal information; and
  • Not be discriminated against for exercising your rights.

We do not sell or share your personal information as those terms are defined under the CCPA/CPRA. To exercise your California rights, contact us at privacy@learn-360.com.

14. Children's Privacy

Learn 360 is designed primarily for businesses and organizations.

Accounts must be created by adults.

We do not knowingly create accounts for, or collect personal information from, children under 13.

Where an Organization provides courses to minors, the Organization or parent/guardian is responsible for obtaining any legally required consent and supervising the minor's use of the Services.

15. Data Processing (Processor Terms)

Where Learn 360 processes personal information on behalf of an Organization (for example, Learner information and Organization-created content), we act as a processor and the Organization acts as the controller. In that role:

  • We process such personal information only on the Organization's documented instructions and to provide the Services;
  • We require persons authorized to process the data to keep it confidential;
  • We implement appropriate technical and organizational security measures (see Section 10);
  • We may engage sub-processors to help provide the Services and remain responsible for their compliance; a current list of sub-processors is available on request, and we will provide advance notice of new sub-processors so the Organization may object on reasonable data-protection grounds;
  • We assist the Organization, where reasonably possible, with data-subject requests and security obligations;
  • We notify the Organization without undue delay after becoming aware of a personal data breach affecting its data; and
  • We delete or return the data at the end of the Services, subject to the retention periods in Section 9.

A separate Data Processing Agreement (DPA) incorporating these terms and, where applicable, the Standard Contractual Clauses, is available to Organizations on request at privacy@learn-360.com.

16. Third-Party Services

Organizations may choose to integrate third-party services with Learn 360.

Those services operate under their own privacy policies, and Learn 360 is not responsible for their practices.

17. Changes to this Privacy Policy

We may update this Privacy Policy from time to time.

When we make material changes, we will:

  • Update the “Last updated” date;
  • Publish the revised Privacy Policy on our website; and
  • Provide additional notice where required by law.

Continued use of the Services after changes become effective constitutes acceptance of the updated Privacy Policy.

19. Governing Law

This Privacy Policy shall be governed by the laws applicable to Edutain360, LLC and any applicable privacy laws in the jurisdictions where our Services are offered. Where local privacy laws provide additional rights, those rights will apply to the extent required by law.
